1st Amendment

By Patrick Van Roy On November 28th, 2020

“It is time — past time — to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues and mosques,” Justice Neil M. Gorsuch.

  1. There is an argument about due process and fairness that can be made when challenging restrictions demanded of different social and commercial and communal premises but ‘ freedom of religion’ and ‘freedom of speech’ is and should be irrelevant to these decisions.

  2. BULLSHIT !

‘freedom of religion’ and ‘freedom of speech’ Freedom of Assembly, over rule everything.

They are NOT cancelled by a Virus.

  3. There are no restrictions here on freedom of religion or speech, and freedom of assembly has always been conditional on other factors , hence the routine requirement of protesters to stick to guidelines on how and when they can hold marches or gatherings . Authorities should always be required to justify the restrictions they place on civilians during all sorts of emergencies, war, civil disorder, pandemics, etc, .But to claim they have NO right to restrict certain gatherings in any circumstances is ludicrous.

  4. Bullshit

  5. “‘freedom of religion’ and ‘freedom of speech’ Freedom of Assembly, over rule everything.”

Which means that the government have absolutely no power to prevent human sacrifice. Or someone inciting violence. Or a mass gathering of people in the situation room of the White House. Because freedom of religion, speech and assembly overrule everthing.

  6. Wrong…..

Good morning Seamus, human sacrifice is murder, but chickens or goats is fine, inciting violence and yelling fire in a theater are unacceptable social norms.

Restriction of Individual Liberty is none of that. You want things black and white when they are grey, and you want them grey when they are black and white.

There comes a time of self reflection where one must question the biases of their own lens.

  7. “Good morning Seamus, human sacrifice is murder, but chickens or goats is fine, inciting violence and yelling fire in a theater are unacceptable social norms.”

So it is acceptable, in certain circumstances, to overrule freedom of religion, speech or assembly. And that those rights don’t “overrule everything”.

  8. I think Patrick has just conceded.

Now if only Donald would do the same 😉

  9. Patrick

If Trump grants himself a pardon before he leaves office, I assume you will support that on the grounds that the constitution allows it?
